Throughout his career, Mr. Gutfleish has represented businesses, business owners, lenders, borrowers, individuals, court-appointed fiduciaries and bankruptcy trustees in all aspects of bankruptcy proceedings and bankruptcy litigation, state court insolvency proceedings, commercial transactions, out of court work-outs, commercial litigation, commercial collections, lien enforcement, and business law.

Since 1993, Mr. Gutfleish has represented the bankruptcy trustees in the United States Bankruptcy Courts for the Districts of New Jersey and Delaware. As counsel to bankruptcy trustees, Mr. Gutfleish has investigated several significant real estate, mortgage, securities, healthcare, and investment frauds committed by debtors and their principals, and has pursued the alleged wrongdoers and others on behalf of creditors. In one matter, the Federal Bureau of Investigation presented Mr. Gutfleish with a Certificate of Appreciation for “outstanding assistance in a joint investigative effort” leading to the criminal prosecution and conviction of various defendants involved in a real estate Ponzi scheme in New Jersey.

In his bankruptcy and commercial litigation matters, Mr. Gutfleish has represented plaintiffs and defendants in a variety of complex litigation involving preference and other actions brought by debtors and bankruptcy trustees, fraud and fraudulent transfers, denial of a debtor’s discharge or the discharge of a particular debt, contract and other commercial disputes, corporate governance and breaches of fiduciary duty, disputes among business owners, debt collection, successor liability and alter ego claims, property interest disputes, lien and other UCC disputes, and contract disputes.

Mr. Gutfleish also assists his clients in forming a business entity, establishing the rights and duties among business owners, commercial transactions and contract preparation, loan transactions and document preparation.

Mr. Gutfleish received his Bachelor of Arts Degree, Cum Laude, from Colgate University in 1985, and received his Juris Doctor Degree, Cum Laude, from Boston University School of Law in 1988, where he served on the Boston University Law Review from 1986-1988.

Mr. Gutfleish is admitted to State Courts of New Jersey and New York, the United States District Court for the District of New Jersey, the United States District Courts for the Southern District of New York, Eastern and Northern Districts of New York, and the United States Courts of Appeals for the Second Third Circuits.

Mr. Gutfleish has served as a panelist for seminars sponsored by the Bergen County Bar Association, the Institute of Continuing Legal Education, the New Jersey State Bar Association, and the National Business Institute including those addressing the basics of chapter 11 bankruptcy practice, issues in cases involving fraudulent and criminal conduct, the pit-falls of bankruptcy for non-bankruptcy practitioners, state law liquidation alternatives, the interplay and tensions between matrimonial and bankruptcy proceedings, and corporate governance in chapter 11 reorganization cases.
